Het moderniseren van gemeentelijke applicaties is een debacle, concludeert Centric in kort geding. Het bedrijf daagt een externe softwarebouwer om de ontwikkeltools in handen te krijgen.

Centric, marktleider op het gebied van gemeentesoftware, ruziet voor de rechter met de ontwikkelaar Lizatec, die het heeft ingehuurd om een serie applicaties te moderniseren. De samenwerking is veranderd in een oorlog.

Inzet van de juridische strijd is de migratie van MVV4all, een set aan applicaties voor gemeenten die vergunningen, bouw- en woningtoezicht en andere zaken registreert. De software is geschreven in de programmeertaal Delphi. Voor bijna één miljoen euro krijgt het bedrijf Lizatec in 2008 de opdracht de broncode om te zetten in .NET-programmatuur. Daarna heet het pakket Key2Vergunningen.

Lizatec is gespecialiseerd in het omzetten van programmatuur en heeft daarvoor een eigen methodiek met de nodige technische tools gemaakt. In Rusland zitten ontwikkelaars en experts die de migratie via een conversieset mogelijk maken. Volgens Centric kan dan met een druk op de knop de nieuwe programmatuur uit het systeem rollen en is er dus een nieuwe versie. De kwaliteit van de conversietool was de reden om voor deze leverancier te kiezen.

Boven het hoofd gegroeid

Maar na een goede start stagneert het proces, meent Advocaat Wouter Seinen van Centric. Hij concludeert dat de opdracht na de eerste fase Lizatec boven het hoofd is gegroeid. Zij zouden niet op tijd leveren, fouten maken en de klus niet aankunnen. Er zouden heldere afspraken zijn, die bij herhaling niet worden nagekomen.

Maar Robert Grandia, advocaat van Lizatec, ziet juist dat zijn cliënt de opdracht prima kan uitvoeren. “Centric laat falen als opdrachtgever buiten beschouwing”, stelt hij. Volgens hem werden verkeerde broncodes aangeleverd, waardoor de migratie stil kwam te liggen. Ook is er nooit een juiste database geleverd. Of het gebeurde niet of de testdata bleek vol met fouten te zitten. Centric is onprofessioneel, sneert de advocaat en stelt dat zij nauwelijks het eerste volwassenheidsniveau van CMMI halen.

Hij typeert MVV4all een verzameling oude systemen “die wel 20 tot 30 jaar oud zijn en waar veel onderhoud op is gedaan.” Het is dan ook een lappendeken, die niet altijd even goed onderhouden is. “Veel fouten in de software, die eerder geen probleem waren, komen nu naar boven en zijn dat nu soms wel”, stelt de raadsman dan ook. “Wat Lizatec doet is de software jong en vitaal maken.”

Toegang tot de tools en personeel

Centric ziet een samenwerking niet meer zitten en zegt de overeenkomst op. Het bedrijf beweert dat in de overeenkomst is afgesproken dat zij nu recht hebben op de tools om zelf de klus af te maken en eisen ook ondersteuning van Lizatec om met de hulpmiddelen te kunnen werken. Van betaling wil de marktleider in gemeentesoftware niet weten.

Lizatec zegt mee te willen werken, maar eist garanties. “Met de tools zijn veel meer projecten om te zetten”, vreest Grandia. Hij benadrukt dat er meer dan 60.000 uur in de ontwikkeling van de methodiek en de tools zitten. Daarbij is het een groot bedrijf dat een kleine onderneming in de verdrukking laat komen. “Het gaat hier om een heel specialistisch bedrijf dat iets heeft dat anderen niet hebben. Voor het voortbestaan kan het daarvan afhankelijk zijn.”

Woede uitbarsting rond overnamepogingen

Dat die vrees terecht is blijkt volgens de raadsman uit diverse pogingen de migratie-expert te willen overnemen. Centric stelt dat zij in het begin brood zagen in samenwerking en erkent de kwaliteit van de Russische experts hoog in te schatten. “Er wordt gesproken over een overname”, stelt Lizatec. Dat onderhandelingen zijn mislukt, komt volgens de advocaat doordat er wordt gespeeld op het overnemen van personeel en niet op het krijgen van werkende software. Hij wil hier dan ook bescherming tegen.

De raadsman stelt dat Karim Henkens, algemeen directeur van Centric Solutions, geprobeerd heeft achter de personalia van het personeel te komen, een van de directeuren van Lizatec gebeld heeft met het aanbod haar een baan aan te bieden en het personeel bij Centric in dienst te laten komen om vervolgens Lizatec te laten ploffen. Volgens Henkens zijn dit leugens: “Ik protesteer hier echt tegen. Dit zijn absolute leugens. Dit is niet waar! Dit is niet waar!”

Arbitrage

Wat Lizatec betreft hoeft de rechter niet veel te doen. De kemphanen hebben namelijk een zaak lopen bij de Stichting Geschillenoplossing Automatisering (SGOA), die naar het conflict kijkt en daarom zou de rechter geen rol hebben. In die procedure is het mogelijk een soort kort geding (arbitrage) te voeren en dat zou heel snel kunnen gaan. Centric vindt dat onzin, want de Stichting heeft in 25 jaar maar 60 spoedprocedures gedaan en heeft meer vertrouwen in de rechtbank.

Mocht er toch een inhoudelijke uitspraak komen dan wil Lizatec minimaal €100.000 voor nog openstaande rekeningen. Daarnaast willen ze geld voor hun tools en mensen plus de nodige bescherming tegen misbruik van hun intellectueel eigendom. Het bedrijf zegt wel te kunnen overleven, omdat ze kapitaal hebben aangetrokken, maar erkent dat het wel moeilijk is geweest. Centric beweert dat personeel van hun leverancier vier maanden op salaris hebben moeten wachten.

De rechter doet over twee weken uitspraak. “Overbodig”, zegt Lisette Breukink, directrice van Lizatec. “Als ze gewoon de rekening hadden betaald en hadden meegewerkt dan hadden ze nu hun software gehad.” Centric wil verder niet op de zaak te reageren

LEEUWARDEN – Politie en justitie hadden tijdens een strafrechtelijk onderzoek geen gebruik mogen maken van de registratiecamera’s boven de A28. Dat blijkt uit een uitspraak van het gerechtshof in Leeuwarden van woensdag.

Het hof heeft om die reden twee mannen vrijgesproken van 21 autodiefstallen in Noord- en Oost-Nederland. Het tweetal kon worden gepakt dankzij het omstreden kentekenregistratiesysteem (ANPR) op de A28 bij Zwolle.

Volgens het gerechtshof ontbreekt elke wettelijke basis voor het gebruik van het registratiesysteem bij een opsporingsonderzoek. Het hof is ook van oordeel dat het Openbaar Ministerie had kunnen weten dat camerabeelden in de zaak niet zouden worden toegestaan als bewijs.

”Uit Kamerstukken blijkt dat de minister vindt dat voor uitvoering van het plan onvoldoende wettelijke basis bestaat”, zo zegt het hof.

Spoor

De politie kwam het tweetal op het spoor, toen het opviel dat er vaak een auto van de mannen in de buurt reed van een gestolen auto. Die gegevens had de politie niet mogen bewaren, vindt het hof.

De mannen waren namelijk op dat moment niet verdacht en stonden dus niet in het systeem. ”Er is achteraf een vergelijking gemaakt”, zegt het hof. ”En gegevens die geen hit opleveren, dienen direct te worden vernietigd.”

Uitspraak

Het gerechtshof spreekt hiermee de uitspraak van de rechtbank in Zwolle vorig jaar tegen. De rechtbank vond het ANPR een goed middel tegen de voertuigcriminaliteit en veroordeelde de mannen tot een celstraf van drie jaar. Dat eiste het OM in hoger beroep opnieuw.

De mannen zouden met magneetjes autosleutels uit brievenbussen bij garages hebben gehengeld en op die manier de auto’s hebben gestolen. De diefstallen vonden plaats van april 2008 tot en met januari 2009.

Voor een poging tot diefstal op dezelfde manier in Duitsland, kregen de mannen wel een straf: tien weken cel. Die hebben de mannen in voorarrest al uitgezeten.

DRUNKEN and hungover parrots are dropping out of the sky in the Northern Territory.

The red collar lorikeets eat a mystery food, lose coordination and pass out, says Lisa Hansen, a founding member of the Ark Animal Hospital at Palmerston, near Darwin.

"It happens every year around this season, they lose all balance and we do find them fallen out of trees and the sky," Ms Hansen said.

"It seems that the birds get intoxicated by something they have eaten and it renders them unable to fly and function correctly.

"And then they can get very sick as a result."

She doesn’t know what the birds are eating but says about eight a day are brought to the hospital after falling into backyards and along roadsides.

"Sometimes they need intensive care before we can put them out in the aviaries until they can fly again," Ms Hansen said.

SYDNEY (AFP) – Australia has launched international legal action to stop Japan killing hundreds of whales a year in the name of science, officials said Tuesday, as Tokyo condemned the move.

Australia’s case at the International Court of Justice (ICJ) seeks to stop Japan exploiting a loophole in a 1986 global moratorium which allows whaling for research purposes, according to documents seen by AFP.

Between the 1987/88 season and the 2004/2005 season Japan killed 6,800 minke whales for research in the Antarctic alone, compared with 840 worldwide in the 31 years before the moratorium, Australia’s application said.

A further 2,595 minke whales were killed between 2005/06 and 2008/2009.

"The scale of killing, taking and treating carried out under this programme greatly outweighs any previous practice undertaken on the basis of scientific permits in the history of the IWC (International Whaling Commission)," it said.

"Whale-meat caught during JARPA I (a Japanese research whaling programme) was taken to Japan where it was placed on commercial sale," the application added.

Hirofumi Hirano, Japan’s top government spokesman, said the move, which tests relations between the key trading partners, was "extremely regrettable," while foreign ministry officials said they were "studying our strategy regarding the lawsuit."

"Details are yet to be decided, but we won’t disclose our strategy even after we make a decision," an official told AFP in Tokyo.

Australia’s claim asks the ICJ to "adjudge and declare that Japan is in breach of its international obligations in implementing the (research whaling) programme in the Southern Ocean."

It urges the ICJ to order that Japan "cease implementation of (research whaling and) revoke any authorisations, permits or licences allowing the activities which are the subject of (this) application to be undertaken".

Foreign Minister Stephen Smith played down fears that the lawsuit could backfire if it fails by giving Japan’s hunts a degree of legitimacy.

"Any legal action carries with it a chance or a prospect of success, equally there can be no guarantee of success, so we are confident that the action we have taken is the best action to advance our policy objective which is to see Japan cease whaling in the Southern Ocean," Smith said.

Canberra has long opposed Japan’s annual whaling expeditions in Antarctic waters, and has in recent months hardened its stance, culminating in Friday’s announcement of legal action.

Japanese whalers have clashed in recent years with militant activists from the Sea Shepherd Conservation Society who harass them on the high seas.

In their annual clashes, the adversaries regularly trade icy jets from water cannon, while the environmentalists hurl blood-red paint containers and rancid butter, or butyric acid, stink bombs at the whaling ships.

One environmentalist, Peter Bethune, is on trial in Japan after boarding a Japanese ship in February, and faces up to 15 years in prison if convicted.

The New Zealander last week pleaded guilty to all charges except one for assault, which relates to his firing a stink-bomb during a February 11 clash with the whalers.

Australia’s legal action also comes before the June 21-25 annual meeting of the International Whaling Commission, which will discuss a compromise proposal to end years of divisions among its pro and anti-whaling members.

The plan would allow Japan — as well as Iceland and Norway, which kill whales in defiance of the moratorium — to hunt the mammals openly if they agree to reduce their catch "significantly" over 10 years.

Australia has attacked the compromise, under which Japan’s Antarctic catch would go down to 410 whales next season — from about 500 this year — and then to 205 in the 2015-2016 season.

In de Australische aanklacht staat dat Japan op grote schaal walvissen vangt, ondanks internationale regelgeving.

Canberra stelt verder dat Tokio met de walvisvaart vele andere afspraken over natuurbehoud schendt.

Betrekkingen

De Australische regering kondigde eerder aan de stap naar het ICJ te zullen zetten. De overheid beklemtoonde dat de zaak enkel betrekking heeft op de walvisvaart.

Volgens de Australische minister van Milieubescherming Peter Garrett zijn de betrekkingen tussen beide landen verder goed.

Japan vangt en doodt elke zomer op de zuidelijke oceanen walvissen. Internationale afspraken over het uitbannen van de walvisvaart staan wel de vangst van deze dieren voor wetenschappelijk onderzoek toe.

THE dream of flying from Australia to Europe in three hours has taken another step toward reality with the second "hypersonic" flight in the outback.

Until now air travel at "hypersonic" speed was the stuff of science fiction.

But Australian and US defence boffins at Woomera military range launched a plane which hit speeds of 5840km/h, more than twice as fast as the fastest jet fighter and six times quicker than today’s airliner, but 3000km/h slower than last year’s first flight.

Such velocity would propel an aircraft from Sydney to London in just 2.9 hours, reports The Daily Telegraph.

The new technology, known as Hypersonic International Flight Research Experimentation or HIFiRE is being developed by scientists from Australia’s Defence Science and Technology Organisation and the US Air Force.

As usual, it will be adopted by the military before being used to propel travellers through space at 5800km/h.

The Woomera test involved blasting a vehicle 200km into space on a rocket before it dived back through the atmosphere at hypersonic speed, transmitting data before breaking up and crashing to the ground 10 minutes after launch.

Defence Science Minister Greg Combet said the flight was a "significant milestone" giving scientists critical data for a sustained hypersonic engine.

Veel reizigers zien op tegen de lange en intensieve vlucht naar Down Under. Maar in een paar uur tijd van Europa naar Australië vliegen is weer een beetje meer realiteit geworden.

Militaire wetenschappers hebben in de Australische outback een test vliegtuig gelanceerd dat een snelheid behaalde van maar liefst 5.840 km per uur, dit meldt de Australische krant Daily Telegraph.

De snelheid die het vliegtuig tijdens de test haalde is dubbel zoveel als de snelste straaljager en zes keer sneller dan een hedendaags commercieel lijnvliegtuig.

Realiteit

De zogenaamde ‘hypersonische’ vliegtuigen werden tot voor kort als science fiction afgedaan, maar de Australische tests bewijzen dat dat wel eens realiteit zou kunnen worden. Met de snelheden die de ‘hypersonische’ vliegtuig behaalde zou het toestel in bijna drie uur van Sydney naar Londen kunnen vliegen.

De nieuwe technologie, Hypersonic International Flight Research Experimentation (HIFiRE), wordt momenteel ontwikkeld door wetenschappers van het Australische en Amerikaanse leger. Vaak is het zo dat nieuwe technologie eerst voor militaire doeleinden gebruikt wordt, voordat het commercieel op de markt wordt aangeboden.

Het duurt dus nog wel even voordat u als toerist in drie uur tijd naar Australië kunt.

A Russian awarded $1million (£666,000) for solving one of the most intractable problems in mathematics said yesterday that he does not want the money.

Said to be the world’s cleverest man, Dr Grigory Perelman, 44, lives as a recluse in a bare cockroach-infested flat in St Petersburg. He said through the closed door: ‘I have all I want.’

The prize was given by the U.S. Clay Mathematics Institute for solving the Poincare Conjecture, which baffled mathematicians for a century. Dr Perelman posted his solution on the internet.

Four years ago, the maths genius failed to turn up to receive his prestigious Fields Medal from the International Mathematical Union for solving the problem.

At the time he stated: ‘I’m not interested in money or fame. I don’t want to be on display like an animal in a zoo.

‘I’m not a hero of mathematics. I’m not even that successful, that is why I don’t want to have everybody looking at me.’

Neighbour Vera Petrovna said: ‘I was once in his flat and I was astounded. He only has a table, a stool and a bed with a dirty mattress which was left by previous owners – alcoholics who sold the flat to him. 

‘We are trying to get rid of cockroaches in our block, but they hide in his flat.’

It was in 2002 that Perelman, then a researcher at the Steklov Institute of Mathematics in St. Petersburg, began posting papers online suggesting he had solved the Poincare Conjecture, one of seven major mathematical puzzles for which the Clay Institute is offering $1 million each.

Rigorous tests proved he was correct. 

The topological conundrum essentially states that any three-dimensional space without holes in it is equivalent to a stretched sphere.

The puzzle was more than 100 years old when Perelman solved it – and could help determine the shape of the universe.

After 2003 Perelman gave up his job at the Steklov Institute. Friends have been reported as saying he has resigned from mathematics altogether – finding the subject too painful to discuss.

In: SQL Server

Despite being completely proprietary, one of the nice connectivity features offered in SQL Server is the ability to query other servers through a Linked Server. Essentially, a linked server is a method of directly querying another RDBMS; this often happens through the use of an ODBC driver installed on the server. Fortunately, many popular databases provide this ODBC driver, giving SQL Server the ability to connect to a wide range of other systems. I’ve already written about how to connect Oracle and SQL Server. In this post, I’m going to go through the steps necessary to connect SQL Server and MySQL.
The first step is to fetch an appropriate MySQL Connector/ODBC 5.1 download. Drivers are available for a variety of OS’s, but we’re obviously focused on Windows or Window x64, which should correspond to the version of SQL Server installed. After you’ve downloaded and installed the driver, we have a few things to configure, so let’s get started:

Configure a MySQL DSN

The first step is to configure a MySQL data source by running the ODBC Data Source Administrator. This step is technically entirely optional, but allows a simpler configuration in the SQL Server Linked Server settings. Instead of composing a complicated MySQL connection string, we can use a simple GUI application.

Run odbcad32

If you’re using Windows Server 2003, bring up a Run dialog box with Start→Run or WinKey+R. If you’re using Windows Server 2008, use the Start Menu search box directly. In either OS, type in “odbcad32″ and hit Enter.

System DSN

Select the System DSN tab to configure a data source for the entire system. If you only want to create the DSN for a specific user (such as your service account), use the User DSN tab. In either scenario, select the “Add…” button.

Create New Data Source

Scroll down in the Create New Data Source window and select “MySQL ODBC 3.51 Driver” and click “Finish”.

MySQL Connector Login Settings

Once added, clicking the “Configure…” button will bring up the Connector/ODBC 3.51 Configure Data Source application. This is where you can specify all the connection settings for connecting SQL Server to MySQL. Select a Data Source Name – I typically name it after the application or database I’m connecting to. The Server, User, Password, and Database should all be obvious.

Test ODBC Connection

After you’ve entered all the required parameters, click the “Test” button to ensure a connection can be made to the MySQL server.

These settings are the bare minimum required to connect MySQL and SQL Server via a linked server, but I like to specify additional options to optimize the connection between the servers. Without these, I have run into “Out of Memory” errors that require restarting the service.

MySQL Connector Advanced Flags 1 Settings

Select the Advanced tab and you’ll be placed on the “Flags 1″ sub-tab. Check the boxes labeled “Allow Big Results” and “Use Compressed Protocol”.

Next, switch to the “Flags 2″ tab and select “Don’t Cache Result (forward only cursors)”. This can actually be a performance penalty if you perform the same query multiple times to the same linked server. However, in my experience, the reason to connect SQL Server to MySQL, is to pull data into a single server, in which case, this option is perfectly suited.

MySQL Connector Advanced Flags 3 Settings

On the “Flags 3″ tab, select “Force Use Of Forward Only Cursors”. When you’re done setting all these options, select the “Ok” button.

Configure Linked Server Provider

Adjusting the Linked Server Provider is simple, but it comes with a caveat: When adjusting a provider, you are adjusting it for all connections using that provider. I am not aware of any way to change these settings on a per-connection basis.

Provider Properties

Drill down to Server Object → Linked Servers → Providers, right-click MSDASQL, and select “Properties”.

Set Provider Options

The Provider Options for Microsoft OLE DB Provider for ODBC Drivers dialog box will open allowing you to configure several options. Ensure the following four options are checked:

· Nested queries

· Level zero only

· Allow inprocess

· Supports ‘Like’ Operator

All other options should be unchecked. When done, click “OK”.

Create Linked Server to MySQL

Finally, the last step in our process is to create the actual MySQL Linked Server.

Create a New Linked Server

You should already have Linked Servers expanded in the Object Explorer tree. If not, find it in Server Objects → Linked Server. Once there, right-click Linked Servers and select “New Linked Server…”

New linked Server Settings

The New Linked Server dialog box will open. Because we specified all our connection settings in the ODBC Data Source Administrator, this last step is very simple. Name the linked server. As with the Data Source Name, I like to name it after the product or database I’m connecting to. In my example, I used MYSQLAPP. Ensure that the “Other data source” option is selected and choose “Microsoft OLE DB Provider for ODBC Drivers” from the Provider dropdown. Lastly, specify the Product name and Data source. The Product name doesn’t matter so much as the Data source must match what you provided in the MySQL Connector/ODBC configuration. Press “OK” when complete.

Testing the SQL Server to MySQL connection

If everything has been set correctly, you should be able to execute a query directly again the MySQL database from SQL Server Management Studio. For example:

SELECT TOP 10 TABLE_NAME FROM MYSQLAPP…tables WHERE TABLE_TYPE != ‘MEMORY’

If you’ve done everything correctly, you should get back a result set. There are several error message you might receive:

OLE DB provider "MSDASQL" for linked server "MYSQLAPP" returned message "[Microsoft][ODBC Driver Manager] Data source name not found and no default driver specified".

Msg 7303, Level 16, State 1, Line 1

Cannot initialize the data source object of OLE DB provider "MSDASQL" for linked server "MYSQLAPP".

The message indicates that the Data source name you’ve specified for the linked server does not match that of the Data Source Name specified in the MySQL Connector.

Msg 7313, Level 16, State 1, Line 1

An invalid schema or catalog was specified for the provider "MSDASQL" for linked server "MySQLApp".

This uninsightful error is a result of not correctly setting the options for the Linked Server Provider.

Msg 7399, Level 16, State 1, Line 1

The OLE DB provider "MSDASQL" for linked server "MySQLApp" reported an error. The provider did not give any information about the error.

Msg 7312, Level 16, State 1, Line 1

Invalid use of schema or catalog for OLE DB provider "MSDASQL" for linked server "MySQLApp". A four-part name was supplied, but the provider does not expose the necessary interfaces to use a catalog or schema.

This “four-part name” error is due to a limitation in the MySQL ODBC driver. You cannot switch catalogs/schemas using dotted notation. Instead, you will have to register another DSN and Linked Server for the different catalogs you want to access. Be sure and follow the three-dot notation noted in the example query.

If, however, you want to access other schemas, you can do so utilizing OPENQUERY. This is also a great way to test your connection if you’re receiving problems. The syntax looks like this:

SELECT * FROM OPENQUERY(MYSQLAPP, ‘SELECT * FROM INFORMATION_SCHEMA.TABLES LIMIT 10′)

Notice that the actual query syntax in the string must be in the MySQL format (SQL Server does not support the LIMIT keyword). Additionally, you can specify a different schema using SCHEMA.TABLENAME in the query.

Conclusion

Creating a linked server between SQL Server and MySQL is a simple process. The first time requires you to install the software and configure the Linked Server Provider, but all subsequent connections require only a DSN and Linked Server.

Due to a recent update for Windows 64-bit systems it is possible that BitDefender detects several Windows and BitDefender files as infected with Trojan.FakeAlert.5 .
Following this event, in some instanced BitDefender and/or Windows did not work properly anymore (PC failed to boot or certain applications did not work anymore )
